The Countryside and Rights of Way Act 2000, Access Appeals (England)

Introduction

Part I of the Countryside and Rights of Way Act 2000 sets out measures to allow access to open country (mountain, moor, heath and down) and registered common land in England and Wales. Those measures include three types of appeal to the Secretary of State for Environment, Food and Rural Affairs.

Mapping Appeals

Chapter I of the Act requires the statutory bodies (in England, the Countryside Agency) to prepare maps of open country and registered common land. Any person with an interest in the land may appeal to the Secretary of State against its inclusion on the provisional map as open country or registered common land.

Legal challenges to decisions taken in relation to 2 parcels of land in Buckinghamshire during the original area 7 mapping process has led to Natural England repeating the process from the Draft Map consultation stage. The consultation was solely for 2 parcels of land situated at Richmore Hill and Grays Lane Bank. The provisional map has now been published and an appeal has been received in relation to the mapping as open country of the land at Grays Lane Bank.
