Procedures

The inquiry was subject to the:

Town and Country Planning (Major Infrastructure Project Inquiries Procedure) (England) Rules 2002 in respect of the application for the container port.

Town and Country Planning (Inquiries Procedure) (England) Rules 2000 for the proposal for the construction of the small boat harbour in the vicinity of Gas House Creek, and for listed building consent for the partial demolition of the Grade II Listed Train Ferry Gantry structure at Gas House Creek.

Although there are no statutory Inquiries Rules governing the applications for Tidal Works or Coast Protection Act consent, for consistency of approach it has been decided that the spirit of the above Rules should be applied to those applications.

Circular 2/2002 contains information about the 2002 Rules.

Circular 5/2000, Annex 4 contains useful information and guidance on such topics as Statements of Case, Proofs of Evidence, inquiry documents, etc.
