15 Costs

Main Parties

Normally you and the council will pay for your own expenses in an appeal.
You can only claim costs when you can show that the council has behaved in
an unreasonable way causing unnecessary expense. The council can also make
a claim against you for similar reasons. At the moment you cannot claim costs
in written representation cases, only hearings. At a hearing either you or the
council can ask for the other to pay costs. Our Inspector will consider an
application for costs only if it is made before the hearing ends and the person
making the claim can show that the other side has behaved unreasonably and
put them to unnecessary expense.

Other Interested Parties

Generally speaking, parties, other than the appellant and the council, who
appear at the hearing, will rarely be involved in claims for costs. If 3rd parties
choose to take part in appeal proceedings, they do so at their own expense.
