Hazardous Substances Consent Appeal Form PDF Format '''' 176kb

Background Information

Applications are made to the Hazardous Substances Authority (HSA). An application may be for new Hazardous Substances Consent, to remove conditions from, or continue existing consent. HSA's may provide different forms for the various types of applications, and there are some essential documents that must accompany the forms. The HSA must give a written notice of their decision within 8 weeks from when the application is received, or within an extended period that has been agreed in writing. Depending on the outcome, you may wish to exercise your right of appeal.

The appeal procedures to be followed are set out in the Planning (Hazardous Substances) Regulations 1992, as amended.

Guidance is also given in Circular 20/01, 'Planning Controls for Hazardous Substances' http://www.wales.gov.uk/subiplanning/content/circulars/hazardous-e.pdf

Please Note

By virtue of article 3 of the National Assembly for Wales (transfer of Functions) Order 1999 (S.I.1999/672), together with section 118(3) of the 2004 Act, the functions of the Secretary of State in such matters are now exercisable by the National Assembly for Wales.
