You and the LPA normally have to meet your own appeal expenses, whether it is decided by the written procedure, a hearing or an inquiry.

Whichever procedure is used, you can ask the Assembly or the Inspector to order the LPA to pay all or some of your costs. The LPA can also ask the Inspector to order you to pay all or some of their appeal costs.

But costs will only be awarded against you or the LPA if the Inspector considers either of you has acted unreasonably and, as a result, the other has had to pay more than they should have to deal with the appeal.

Where an inquiry or hearing is held, any costs application should be made to the Inspector. If your appeal is by written representations, any costs application should be made to us in writing.
