Guide to taking part in advertisement appeals
3 Who can appeal?
3.1 Only the person, or business, applying for consent
to display an
advertisement can appeal against the council’s decision. If a council
issue a discontinuance notice, only those receiving a copy may appeal.
We call the person making the appeal ‘the appellant’.
4 How to make an appeal
4.1 You will make your appeal to the First Secretary of
State in England and
to the National Assembly for Wales in Wales. Most are decided by
specialist Inspectors in the Planning Inspectorate.
4.2 You should use our advertisement appeal forms.
4.3 If the appeal site is in England, you can get forms from our Customer
Support Unit (0117 372 6372). Please ask for form number PINS PF08.
If the appeal site is in Wales, you can get forms from our Cardiff office
(029 2082 3866).You can also obtain forms from the Planning
Inspectorate’s website www.planning-inspectorate.gov.uk.
4.4 You will find advice on how to fill in the appeal form in Appendix
1 at
the back of this leaflet.
5 How long do I have to appeal?
5.1 The time limits for sending us your appeal are:
- within eight weeks of the date you receive the council’s decision;
- if the council have not decided on your application, within eight
weeks after the decision period has ended, or any extended period
which you may have agreed to in writing; or
- if you have received a copy of a discontinuance notice, you must
appeal before the date given in the notice telling you when it
comes into effect.
5.2 Unless you have good reasons for sending your appeal out of time,
we
do not normally accept an appeal that is late.
