Statutory procedures

In so far as the inquiry dealt with these called-in planning applications, it will be subject to the statutory procedures set out in the Town and Country Planning (Inquiries Procedure) (England) Rules 2000.

Similarly, in so far as the inquiry dealt with the application for the Fawley Branch Line Improvement Order, it will be subject to the Transport and Works (Inquiries Procedure) Rules 1992.

There are no equivalent statutory rules of procedure governing the other matters before the inquiry. However, in order to maintain a coherent approach, the Secretary of State for the Environment, Transport and the Regions has indicated that the spirit of the statutory rules should apply to all the matters before the inquiry.

The Department's Circular 5/2000, Annex A contains useful information and guidance on such topics as Statements of Case, Proofs of Evidence, inquiry documents, etc.
