London Gateway (Shell Haven) InquiryInquiry ProgrammeOutline Programme Presentation of EvidenceFollowing the decision of 11 November 2002 by the Secretaries of State that the Inquiries should be held concurrently, the Inspector's recommendations will be made separately on each of the three parts - the planning application under appeal (OPA), and the applications for the Transport and Works Act Order (TWAO) and for the Harbour Empowerment Order (HEO) - and will extend to consideration of the cumulative effects of the proposals. The Inspector has advised that evidence, and all opening and closing submissions, should be divided as follows: 1. Any background common to two or three parts "Cumulative effects" includes any case which seeks to establish that one or two parts should not proceed without another part. Whether one or two parts could not proceed without another part should be a matter of submission rather than evidence. Evidence in a topic may allude to conditions or obligations, where these are integral to the case. Evidence given in the conditions and obligations topic must then be cross-referenced to the evidence given in the appropriate topic.
