Lawful Development Certificate Appeals

An appeal under section 195 of the Town and Country Planning Act 1990 can arise following the refusal of an application for a certificate of existing lawful use or development under section 191 or a certificate of proposed lawful use or development under section 192. Table 25 shows the number of appeals received, withdrawn, decided and in hand over the last 3 years. Following a change in legislation on 24 March 1997 all cases received from that date have been or will be decided by Inspectors. Cases received prior to that date were decided by the Secretary of State.
