Planning Appeals - England

Planning Appeals form the largest block of our work. The number of appeals received in 2000-2001 was up by 4%, while the number of decision issued increased by 2% in the previous year. Table 3 gives details of planning appeals received, withdrawn, decided and allowed during the year. At 31 March 2001 we had 5,600 cases in hand.

During the year Inspectors made over 99% of appeal decisions, with the remainder decided by the Secretary of State. Table 4 shows appeals decided by Inspectors and the Secretary of State and the numbers allowed.

Planning appeals can be determined following an exchanged of written representations, an inquiry or a hearing. Chart 1 shows the percentage of appeals decided by the three procedure types with written representation and inquiry appeals split between those determined by Inspectors and the Secretary of State. The figure for hearings includes appeals determined by the Secretary of State.

Tables 5, 6 and 7 show the number of appeals decided by written representations, inquiries and hearings respectively. They also show a breakdown between those determined by the Secretary of State and Inspectors.

The Inspectorate's performance against appeals targets is measured as the time taken to determine 80% of appeals. The Ministerial targets for planning appeal work in England were to determine 80% of planning appeals decided by written representation within 17 weeks, hearing cases within 23 weeks and inquiry cases within 33 weeks. Charts 2 and 3 show the 80% handling times by procedure type for both Secretary of State and Inspector cases over the last 5 years.

The planning appeals we receive relate to a wide range of development types. These are listed in Table 8 and 9.
