The Stansted Airport Limited (Land at and in the Vicinity of Stansted Airport – Second Runway) Compulsory Purchase Order 2008
Application for a certificate under section 19(1)(a) Acquisition of Land Act 1981 – compulsory purchase of land forming part of a common
The Secretary of State for Transport has already called for an inquiry into objections made to The Stansted Airport Limited (Land at and in the Vicinity of Stansted Airport – Second Runway) Compulsory Purchase Order 2008. If confirmed, part of the Order will authorise the compulsory purchase of land which forms part of common land and village green at Moleshill Green, Takeley. Stansted Airport Ltd and BAA Ltd has asked the Secretary of State for Environment, Food and Rural Affairs to issue under Section 19(1)(a) of the Acquisition of Land Act 1981 an exchange land certificate, if he is satisfied that there will be given in exchange for the common land and village green, other land not less in area, and equally advantageous.
A notice of intention to issue a certificate under Section 19(1)(a) of the 1981 Act was published on the 20 and 27 November 2008; the objection period ended on 18 December 2008. Following consideration of the application and the representations made, the Secretary of State for Environment, Food and Rural Affairs has decided that this application should be considered by way of a local inquiry. That inquiry will be concurrent with the other inquiries into the proposal for a second runway at Stansted Airport.
The Inquiry start date is deferred from 15 April 2009, pending a further announcement by the Secretary of State for Communities & Local Government.
