Section 44 Order

Stansted Airport Second Runway: Application by Stansted Airport Limited (“STAL”) for an Order under Section 44 of the Civil Aviation Act 1982 (No 1)

The above application has been submitted by Stansted Airport Limited (“STAL”) to the Secretary of State for Transport, to obtain rights over land to enable the provision of an aviation fuel pipeline in connection with STAL’s proposals for a second runway at Stansted Airport.

Public inquiry into the application

The Secretary of State for Transport has decided to hold a public local inquiry into the application, concurrently with the inquiries called by the Secretaries of State for Communities and Local Government, for Transport and for Culture Media and Sport, into various other applications and orders in connection with the proposed runway.  

Unlike the inquiries being held under the Highways and Town and country planning legislation, there are no detailed rules relating to the conduct of inquiries into applications under Section 44 Civil Aviation Act.  However, the Secretary of State considers that it would be helpful to the decision making process to follow the spirit of the procedures for the other inquiries.  Accordingly, the Secretary of State has decided to request STAL to provide a statement of case and to offer objectors to the application the opportunity of providing a statement of case if they wish to do so.
